Claims and defences in the Magistrates' Courts, including unlawful arrest claims.
§ 3.6Civil litigation
When a dispute can't be settled, we take or defend claims in the Magistrates' Courts.
If you were unlawfully arrested or detained, you may have a damages claim against the state. Strict time limits apply, so act quickly.
Unlawful arrest: written notice to the state is generally due within six months of the arrest.
We review the facts, documents and time limits that apply.
We send a letter of demand or the required notice.
If the matter isn't resolved, we proceed in the appropriate court.
Most debts prescribe after three years. Claims against organs of state, such as unlawful arrest claims, also require written notice within six months.
