Bail applications, trial representation and advice from the first appearance onward.
§ 3.1Criminal law & bail
Following an arrest, a person must be brought before court within 48 hours. At the first appearance, the State will indicate whether it opposes bail, and the applicable bail procedure will determine what is required to secure release.
Bail applications, particularly Schedule 5 and Schedule 6 matters, involve specific legal requirements and evidentiary considerations. If you are unfamiliar with what is required, legal assistance from the start helps ensure the application addresses them. The outcome determines whether you remain in custody.

WhatsApp or call with the person's name, the police station where they are held, the CAS number and the name of the investigating officer, if you have them.
We gather the relevant information for your bail application, including your residential address, employment, previous convictions and any pending criminal cases.
We appear at the bail hearing and, if instructed, throughout the trial.
Get the CAS number, the name of the police station where the person is held and the name of the investigating officer (detective) handling the case, and contact an attorney as soon as possible. Ask that no statement be made without legal advice.
A successful bail application must address the interests of justice. Depending on the offence, the court may need to be satisfied that your release is justified or that exceptional circumstances exist.
The court considers factors such as whether you are likely to stand trial, interfere with witnesses or evidence, or commit further offences while on bail. Leonore prepares your application to address the relevant legal requirements and to place the relevant facts before the court.
