Settled and contested divorces, parenting plans and care and contact arrangements.
§ 3.2Divorce & family law
Nobody gets married planning to get divorced, but sometimes divorce is the only route towards peace and happiness.
A divorce affects your finances and your home, and if you have children, it affects them too. The aim is a fair outcome with as little conflict and cost as possible.
Where spouses agree, a settlement agreement can make the divorce simpler and quicker. Where they don't, we guide you through the contested process step by step.
We discuss your marriage, children, assets and what you hope to achieve.
We draft the summons, settlement agreement or parenting plan.
We take the matter through court and keep you informed at each stage.
A settled divorce can be finalised within a few months, depending on the court's roll. Contested divorces take longer, depending on how many issues are in dispute.
The court always considers the best interests of the child. Parents can agree on a parenting plan. Where they cannot agree, the Family Advocate investigates and recommends to the court with which parent the child should primarily live, and sets out the contact rights of the other parent.
