Advice on dismissals, disciplinary hearings and contracts, and representation at the CCMA.
§ 3.7Labour law
Employees facing a disciplinary hearing and employers who must follow a fair procedure both benefit from early advice, before a deadline passes or a procedural step is missed.
Unfair dismissal disputes must be referred to the CCMA or the relevant bargaining council within 30 days. Acting promptly is essential to protect your rights.
We look at the facts and your contract and explain your options.
We prepare the referral or response within the required time.
We assist at conciliation and, where permitted, arbitration.
Legal representation is generally not permitted during conciliation. At arbitration, it depends on the type of dispute and the applicable CCMA rules. Where required, an application for leave to be legally represented must be submitted at least 14 days before the arbitration hearing. If this deadline is missed, an application for condonation may be necessary.
